1. Introduction and Platform Role
Welcome to LohaLink.in ("Platform", "we", "our", or "us"). LohaLink operates strictly as a Business-to-Business (B2B) technology intermediary bridging verified scrap metal sellers with buyers. We provide the digital infrastructure, AI-assisted listing tools, and an integrated escrow payment mechanism. LohaLink is not a party to the actual contract of sale, does not hold title to any scrap metal, and is not a logistics provider.
2. User Eligibility and KYC Compliance
Access to LohaLink is restricted to legally registered business entities in India.
- Users must provide a valid, active Goods and Services Tax Identification Number (GSTIN).
- Suspension or cancellation of a user’s GSTIN by regulatory authorities will result in immediate suspension of the LohaLink account.
- By registering, you confirm you are an authorized signatory of the registered business entity.
3. The Escrow Payment Mechanism
To guarantee transaction security, LohaLink utilizes a third-party nodal/escrow account for all trades.
- Funding: Buyers must transfer the total transaction value (including platform fees and applicable taxes) into the designated escrow account before the Seller is authorized to dispatch the material.
- Release of Funds: Funds are released to the Seller only upon the Buyer confirming "Material Received" on the dashboard, or automatically after 72 hours of documented delivery at the destination weighbridge, provided no dispute is raised.
- No Interest: Funds held in escrow do not accrue interest for either the Buyer or the Seller.
4. Fees, Deductions, and Billing
LohaLink charges a flat Platform Convenience Fee (calculated per tonne) to the Buyer at checkout.
- This fee is non-refundable once a transaction is successfully completed.
- LohaLink facilitates the generation of automated B2B GST invoices on behalf of the transacting parties based on the data provided during the transaction.
5. AI Analysis and Material Quality
LohaLink utilizes Artificial Intelligence (AI) to analyze images and suggest categories or benchmarks.
- These AI features are strictly advisory and do not constitute a binding quality certification or warranty from LohaLink.
- The ultimate responsibility for verifying material grade, weight, and purity rests entirely with the Buyer upon physical receipt.
6. Double-Blind Communication and Anti-Circumvention
LohaLink masks direct contact information (phone numbers, exact yard locations) prior to escrow lock-in to protect platform integrity.
- Users agree to communicate exclusively through LohaLink’s internal chat system prior to completing a transaction.
- Penalty: Any attempt to use LohaLink to discover a trading partner and subsequently complete the transaction off-platform to avoid fees will result in an immediate, permanent ban and potential forfeiture of any funds currently held in the platform's escrow.
7. Prohibited Materials
Sellers guarantee that no listed material contains hazardous, explosive, radioactive, or illegal scrap (including unauthorized railway or military materials). Sellers bear full legal and financial liability for any damages resulting from prohibited materials.
8. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India. Any disputes arising out of or in connection with the use of LohaLink shall be subject to the exclusive jurisdiction of the competent courts in Kolkata, West Bengal.
